Earlier this year, The Buckeye Institute, representing Ohio resident John Ream, filed a lawsuit asserting that government prohibition on the home distillation of spirits exceeds the powers granted to Congress under the U.S. Constitution’s Commerce Clause.
Might this lawsuit succeed? Should citizens be free to distill in their garages and backyards just as they are free to homebrew? And why did government ever get into licensing the manufacturing of strong drink?
